"MSC NAPOLI"
The structural damage sustained by and/or water ingress
into and/or the intentional beaching of the "MSC
NAPOLI" during severe weather on and after 18th
January 2007, her intentional beaching taking place on
20th January 2007 ("the incident").
Notice is hereby given to:
All persons claiming and/or who believe they are entitled
to make claims by reason of or resulting from or in
connection with the incident that:
1. A Group Litigation Order ("the GLO") was made on 3
June 2008 in an action in the Commercial Court of the
High Court of Justice of England and Wales ("the Court"), 2008 Folio 85.
2. The GLO relates to any claim against Metvale Limited, Metvale Limited Partnership, Mediterranean Shipping Company S.A., CargoGulf Inc. or any other person or entity in which it is alleged that any such person or entity breached any obligation or duty they were under
in contract, tort, bailment, under the Hague or Hague-Visby Rules or otherwise, so as to cause the incident
and/or so as to cause loss or damage (including the
incurring of liability to a third party) as a result of the
incident.
3. Under the GLO Clyde & Co LLP of Beaufort House,
Chertsey Street, Guildford, Surrey GU1 4HA, England,
are to maintain a register of all claims of the sort
described above and (unless the Court otherwise orders)
all such claims must be brought and registered on that
register by 3 September 2008; and
4. If you do not make and register your claim as set out above by the date identified in paragraph 3 above, you
may be precluded from bringing it thereafter.
